2. Distinction Between Platform and Restaurants

Texas Chicken™ operates the online services as a technical platform. The food and delivery services offered are provided by independently operated restaurants (franchisees), each of which acts as an independent controller within the meaning of Article 4(7) of the GDPR. There is no joint controllership pursuant to Article 26 of the GDPR.

3. Processed Personal Data

When using the online services, we process in particular IP addresses, device data, and usage data to ensure technical operation. When registering a user account, we process basic personal data such as name, email address, and login credentials. When placing online orders, we process order and delivery data exclusively for technical order processing.

4. Legal Bases

Processing is carried out on the basis of Article 6(1)(b) GDPR (performance of a contract), Article 6(1)(f) GDPR (legitimate interests), and Article 6(1)(a) GDPR (consent), where applicable.

5. Payment Processing

Online payments are processed via external payment service providers. Texas Chicken™ does not receive complete payment details. The payment service providers act as independent controllers.

6. Cookies and Similar Technologies

Our online services use technically necessary cookies to ensure functionality. Optional cookies (e.g. statistics, marketing) are only set with your explicit consent. For audience measurement, we use Google Analytics (Google Ireland Limited) with Google Consent Mode enabled; processing takes place exclusively upon consent pursuant to Article 6(1)(a) GDPR and can be withdrawn at any time via the cookie settings. IP addresses are processed in truncated form. We use the Usercentrics consent management tool to manage your consents.

7. App Functions and Location Data

When using the mobile app, location data may be processed exclusively with your consent in order to display available restaurants. Consent can be withdrawn at any time.

8. Marketing Communications

If you have explicitly given your consent, we use your contact details to send newsletters and information about offers. Consent can be withdrawn at any time.

9. Data Sharing

Personal data is shared only with restaurants for order processing, with technical service providers within the scope of data processing agreements, or where we are legally obliged to do so.

10. Transfer to Third Countries

Personal data is transferred to third countries only where the statutory requirements are met and appropriate safeguards are in place, in particular standard contractual clauses.

11. Data Retention

We store personal data only for as long as necessary for the respective purposes or as required by statutory retention obligations.

12. Data Subject Rights

You have the right at any time to access, rectification, erasure, restriction of processing, data portability, and objection. Where processing is based on your consent, you also have the right to withdraw such consent at any time with effect for the future. Requests should be directed to [email protected].

13. Right to Lodge a Complaint

You have the right to lodge a complaint with a data protection supervisory authority. The supervisory authority competent for us is the Bavarian State Office for Data Protection Supervision (BayLDA), Ansbach.
